1. Information on how to enter forms part of the terms and conditions of entry. Entry into the promotion is deemed acceptance of these terms and conditions.

2. The promoter is The Sydney Bicycle Film Festival.

3. The promotion commences at 12pm on 15 August 2009 and ends on 9 Nov 2009 (Promotion Period).

4. Entry is open only to residents in the Sydney area (or those who are prepared to bring their bike to Sydney for the festival period from 11-15 November 2009 at their own cost) who are 18 years or over (Eligible Entrants), excluding:

a. directors, management, employees and their immediate families of the Promoter, the Promoter’s related bodies corporate and companies associated with this Promotion.

5. To enter, Eligible Entrants must during the Promotion Period:
a. log on to http://www.boutiquecycles.com/ register their full name, e-mail address and phone number;
b. submit photographs of a bike (push bikes, no motorbikes) that belongs to them. All bikes submitted to the gallery must be customised. This includes component choice, paint/decal modifications and gearing modifications.

All entries are subject to moderation for inappropriate language, irrelevance, and inappropriate content before they are deemed eligible. The Promoter reserves the right to disqualify any entry where it reasonably suspects that the content is prohibited by these terms and conditions, any relevant law, or are otherwise deemed inappropriate. This is at the Promoter’s absolute discretion and discussions will not be entered into. Each entrant warrants to the Promoter that their entry is an original work which has not previously been submitted for publication and which does not infringe the rights of any third party, including but not limited to, copyright, trademarks, trade secrets, privacy, publicity, personal or proprietary rights. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of these warranties.

7. The bikes will be submitted into one of seven categories: Mountain, Exotic, BMX, Hybrid, Road, Fixed Gear and Single Speed. A winner from each of these categories will be selected based on popular vote on boutiquecycles.com. An eight winner (BFF Producers’ Pick) will be selected by a panel of experts nominated by the promoters. 
6. The Promoter is not responsible for any problem or technical malfunction of any communications network or any late, lost, incorrectly submitted, delayed, ineligible, incomplete, corrupted or misdirected entry whether due to error, transmission interruption or otherwise.
8. Judging will take place at 5.00pm (AEST) on 9 November 2009 at 40 Smith Street Surry Hills NSW 2010. The decision of the judges is final and no correspondence will be entered into. This is a game of skill and chance plays no part in determining the winners.

10. The winner will be notified by phone and e-mail within 4 working days of judging. The winner must confirm that they will be in attendance at the Bicycle Film Festival on 11-15 November and agree to have their bike on show.

11. There will be eight winners, seven determined by popular vote and one determined by the panel of judges. The maximum total prize value is TBC.
12. Any prizes must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. Prizes are not exchangeable or redeemable for cash or other goods or services. The prize cannot be transferred to any other person, unless agreed to by the Promoter. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.

13. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations and the Promoter reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this promotion.

14. The Promoter, its related bodies corporate and their respective officers, employees, contractors and agents will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect and consequential loss) suffered or sustained in connection with this promotion, the promotion of this promotion or the use of any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

15. The Promoter reserves the right to award the prize to the next best short-listed entry, according to the judges, if the winner is unable to satisfy these terms and conditions or forfeits or does not claim the prize by 5.00pm (AEST) Friday 6 November. Any re-judging will be held at 5pm (AEST) on Saturday 7 November 2009 at 40 Smith Street Surry Hills NSW 2010 and the winner will be notified by phone and e-mail within 2 days of re-judging. The winner must claim the prize by 5.00pm (AEST) 10 November 2009 or it will be forfeited.

16. If for any reason the promotion is not capable of running as planned, including but not limited to, infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any written directions given under applicable law) to cancel, terminate, modify or suspend the promotion. The Promoter also reserves the right disqualify any individual who tampers with the entry process.

17. Entry details remain the property of the Promoter.  The name and photographs may be used for promotional purposes by the Promoter. Entrants consent to the Promoter using personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes.
